The following information provides a simple overview of what happens to your personal data when you visit our websites and/or use the VIZ Designer software and app or special services from our company.

How do we collect your data?

Furthermore, we process your data – if necessary for the provision of our services – which we receive, for example, from cooperation partners as part of the specialist partner program, or which we obtain from publicly accessible sources (e.g. commercial register, press, Internet) or from other companies in the group or are transmitted by other third parties (e.g. a credit reporting agency). Other data is automatically recorded by our IT systems when you visit our website. This is primarily technical data (e.g. internet browser, operating system or time of the page view). This data is collected automatically as soon as you visit our website.

For what and for how long do we use your data?

Part of the data is collected in order to ensure that the website is provided correctly, the use of services and benefits, an improvement of our products, services and offers, the fulfillment of our contractual obligations, in particular a smooth processing of your order, including our services in the event of cancellations, claims for defects and to answer your inquiries or to carry out an application process. Do you have an obligation to provide data?

3. Your data protection rights

As the data subject, you have the right to free of charge to

  • request the restriction of the processing of your personal data if you dispute the accuracy of the data, the processing is unlawful, but you refuse to delete it and we no longer need the data, but you need them to assert, exercise or defend legal claims or you have objected to the processing in accordance with Art. 21 GDPR (Art. 18 GDPR),
  • receive your personal data that you have provided to us in a structured, common and machine-readable format or to request transmission to another person responsible (Article 20 GDPR),
  • revoke your consent once given to us at any time. The revocation of the consent does not affect the legality of the processing carried out on the basis of the consent up to the point of revocation.

The restrictions under §§ 34 and 35 BDSG apply to the right to information and the right to erasure.

If you have asserted the right to correction, deletion or restriction of processing against us, we are obliged to inform all recipients to whom your personal data has been disclosed of this correction or deletion of the data or restriction of processing, unless this proves to be impossible or involves a disproportionate effort. 4. Collection of general data and information

In connection with the use of our website, web shops, user forums and other websites, it is generally not necessary for you to disclose personal data. These can be used without the separate indication of personal data.

However, for statistical purposes and for the continuous optimization of our website, we log every access to our website and every file stored on the website that is called up. We log the name of the retrieved file, date and time of retrieval, amount of data transferred, notification of successful retrieval, web browser used and requesting domain. This usage data is collected anonymously and does not allow any conclusions to be drawn about your person. If necessary, usage profiles are created using a pseudonym. The MEDIOLA website collects a range of general data and information each time you or an automated system access the website. This is data that your Internet browser transmits to us or our web space provider. This general data and information is stored in the log files of the server. Collected can be:

  • browser types and versions used,
  • the operating system used by the accessing system,
  • the website from which an accessing system reaches our website (so-called referrer),
  • the sub-websites, which are controlled via an accessing system on our website,
  • the date and time of access to the website,
  • an internet protocol address (IP address),
  • the internet service provider of the accessing system and
  • other similar data and information,
  • which serve to avert danger in the event of attacks on our information technology systems.

When using these general data and information, MEDIA does not draw any conclusions about the data subject. Rather, this information is required in order to

  • deliver the content of our website correctly,
  • optimize the content of our website and the advertising for it,
  • ensure the permanent functionality of our information technology systems and the technology of our website as well
  • as to provide law enforcement authorities with the information necessary for law enforcement in the event of a cyber-attack.

This anonymously collected data and information is therefore evaluated by MEDIOLA statistically on the one hand and also with the aim of increasing data protection and data security in our company in order to ultimately ensure an optimal level of protection for the personal data we process. The anonymous data of the server log files are only temporarily stored separately from all personal data provided by a data subject.

The legal basis for data processing in connection with server log files is Article 6 Paragraph 1 Clause 1 Letter f GDPR. The data will be deleted as soon as they are no longer required to achieve the purpose for which they were collected. In the case of the collection of data for the provision of the website, this is the case when you end the respective session.

The collection of the data is absolutely necessary for the provision and storage in log files for the operation of our website. There is therefore no possibility for you to object to this data processing.

5. Cookies

The MEDIOLA website uses cookies to recognize multiple use of our offer by the same user/internet connection owner. Cookies do not damage your computer and do not contain viruses. Cookies serve to make our offer more user-friendly, effective and secure. Cookies are small text files that are filed and saved on your computer system via your internet browser.

Most of the cookies we use are so-called “session cookies”. They are automatically deleted after your visit. “Session or session cookies” store a so-called session ID with which various requests from your browser can be assigned to a common session. 6. Registration on our website / registration for your MEDIOLA user account

The registration options on our website and the associated processing of personal data are presented in points 6, 7, 8, 10 and 12 of this data protection guideline.

Registration MEDIOLA user account

We only collect personal data to the extent that you provide it to us in the course of registering for your MEDIOLA user account or as part of a e.g. B. support request initiated by you (see information under point 12) stating your software, components, etc. used. As part of the registration for your MEDIOLA user account, we collect the following data:

  • Valid Email Address
  • First and Last Name
  • License number of the MEDIOLA software, client licenses and plug-ins.
  • A combination of user name and password chosen by you to upload and distribute your created app controls on our cloud server and for any remote access that has been set up.
  • Further voluntary information (e.g. device categories, device types and/or manufacturer names) about the end devices controlled with the MEDIOLA software, as well as for other available services such as the visualization of your consumption data.

To be able to use our VIZ Designer software and app as well as the software AIO CREATOR NEO and the related app AIO REMOTE NEO as well as the apps IQONTROL NEO, IQONTROL, IP QONTROL, VIZ-Designer and SteckerPRO and our AIO Gateway in connection with the software (the software cannot be used without this data), registration of a MEDIOLA user account is required for unique identification and to ensure that only you have access to your system. For this we need from you: 

  • a valid email address
  • a password that only you know
  • your first and last name

After entering the email address, you will receive an email from us asking you to confirm the address. This is how we ensure that you have access to the specified mailbox. The password is not saved in plain text format, but as a so-called hash value. Of course, the provider’s employees do not know the password.

We store your information on specially protected servers at service providers in Germany such as ALL-INKL.COM – Neue Medien Münnich – Hauptstraße 68, D-02742 Friedersdorf, as well as at Amazon Web Services (AWS) with servers in the EU (Ireland and Frankfurt am Main).

By activating the MEDIOLA user account, you give us your consent to our terms of use and license (EULA), the terms of use for cloud servers and services and our data protection guidelines and give us your consent to the processing of your personal data.

Use of cloud services

By deciding to use our services and applying for a MEDIOLA user account or gaining access to it, you have also given MEDIOLA your consent to the collection, storage, processing, use and transmission of personal data in order to provide you with personal functions such as e.g. to provide the visualization of consumption data and operating states. This includes information such as name, address, e-mail address, telephone number and e.g. B. Consumption and device status data, even if these cannot be assigned to a specific person, but have a personal reference due to the context in which they were collected. As soon as the MEDIOLA software or your gateway/server integrated into the local network connects to the services, MEDIOLA records the following data, among other things, in addition to a dynamically assigned and changeable system ID of your gateway and/or the IP address of your server:

All information that you gave us when registering to create the MEDIOLA user account, device list with device categories, device types and/or manufacturer names that you have set for control with the MEDIOLA software, all devices used or taught in, device events (e.g. Error messages from devices, etc.), device actions (states and operation), device connections (automation rules, tasks, scenes and trade profiles, etc.), system events (e.g. system error messages), local user administration data (access rights of different users, etc.), Consumption values, system data of the mobile end devices (operating system, software version and manufacturer) that communicate with the services, the combination of user name and password you have chosen for logging into the MEDIOLA user account, a valid e-mail address, serial number of your software license as well as the local MEDIOLA gateway/server, in-app purchases made and licensed Functional modules (plug-ins) and other functional extensions of the MEDIOLA software.

The data listed is recorded in the MEDIOLA software, processed and transmitted to the MEDIOLA cloud or service server (see MEDIOLA user account registration above). There they are processed and stored.

The processing and storage of this data serves, among other things, to display the status of your devices outside of your local network and, for example, to provide you with an overview of all devices along with consumption data. This data is stored by a service provider as a server provider and made available in a processed form for display. In addition, we anonymize your data and use it to improve the products we offer and our marketing concepts. However, this use does not allow us to draw any conclusions about your person. Any further collection, storage, use, processing or transmission of personal data will only take place on the basis of your express, re-declared consent or within the framework of our statutory information obligations to authorized state institutions or on the basis of a court decision.

The data will be stored as long as your MEDIOLA user account is activated. As soon as the user account is deleted, all data stored online will be deleted. Independent of this are data that you have given us as part of other registrations (e.g. shop account, newsletter, advice community, etc.).

The legal basis for the processing of your data is Article 6 Paragraph 1 Clause 1 Letter a GDPR based on the consent you have given.

Use of components for voice control

In order to use voice control components such as Amazon Alexa and Google Assistant, it may be necessary to transfer personal data to the respective device provider. Some of the products available for our software and apps (AIO CREATOR NEO, IQONTROL NEO, IQONTROL, IP QONTROL) allow voice control via third-party providers (e.g. Amazon Echo via the MEDIOLA Smart Home Skill). Depending on the provider, this may require the transmission of personal data. However, activation of the corresponding services within the applications of the respective third-party provider and subsequent linking to your MEDIOLA user account are required for use.

The data processed for voice control purposes will be stored until you delete this third-party service.

The legal basis for the processing of your data is Article 6 Paragraph 1 Clause 1 Letter a GDPR based on the consent you have given.

7. Subscription to our newsletter

With the following information we will inform you about the contents of our newsletter as well as the registration, dispatch and statistical evaluation procedures as well as your rights of objection. By subscribing to our newsletter, you agree to receive it and the procedures described.

Content of the newsletter

We send newsletters with advertising information (hereinafter “newsletter”) only with the consent of the recipient or legal permission. If the contents of the newsletter are specifically described when registering for the newsletter, they are decisive for the consent of the user. Our newsletter also contains information about offers, product innovations and events.

Double opt-in and logging

Registration for our newsletter takes place in a so-called double opt-in procedure. This means that after registration you will receive an e-mail in which you will be asked to confirm your registration. This confirmation is necessary so that nobody can register with someone else’s e-mail address.

The registrations for the newsletter are logged in order to be able to prove the registration process in accordance with the legal requirements. This includes storing the time of registration and confirmation (date and time) as well as the IP address.

Use of the mail service provider MailChimp

We use the MailChimp component to send our newsletter. MailChimp is a newsletter distribution platform from the US provider The Rocket Science Group, LLC, 512 Means Street, Suite 404, Atlanta, GA 30318, USA.

Your data stored when registering for the newsletter (e-mail address, name if applicable, IP address, date and time of your registration) will be transmitted to a server of The Rocket Science Group in the USA and stored there in compliance with the “EU -US Privacy Shield”.

MailChimp uses this information to send and evaluate the newsletter on our behalf. Furthermore, according to its own information, MailChimp can use this data to optimize or improve its own services, e.g. for the technical optimization of the dispatch and the presentation of the newsletter or for economic purposes, in order to determine from which countries the recipients come. However, MailChimp does not use the data of our newsletter recipients to write to them or pass them on to third parties. We trust in the reliability and the IT and data security of MailChimp. MailChimp is certified under the US-EU data protection agreement “Privacy Shield” and is therefore committed to complying with EU data protection regulations. Furthermore, we have concluded a “Data Processing Agreement” with MailChimp. This is a contract in which MailChimp undertakes to protect the data of our users, to process it on our behalf in accordance with their data protection regulations and, in particular, not to pass it on to third parties. To register for the newsletter via our website, you only need to enter your e-mail address. Optionally, we ask you to enter your first and last name. This information is only used to personalize the newsletter.

Statistical survey and analysis

The newsletters contain a so-called “web beacon”, i.e. a pixel-sized file that is retrieved from the MailChimp server when the newsletter is opened. As part of this retrieval, technical information, such as information about the browser and your system, as well as your IP address and time of retrieval, are initially collected. This information is used to technically improve the services based on the technical data or the target groups and their reading behavior based on their retrieval locations (which can be determined using the IP address) or the access times.

The statistical surveys also include determining whether the newsletters are opened, when they are opened and which links are clicked. For technical reasons, this information can be assigned to the individual newsletter recipients. However, it is neither our aim nor that of MailChimp to monitor individual users. The evaluations serve us much more to identify the interests or preferences of our users and to adapt our content to them or to send different content according to the interests of our users, i.e. personalized newsletters that are relevant to you.

Termination and Revocation

You can cancel the receipt of our newsletter at any time, i.e. revoke your consent. At the same time, your consent to its dispatch via MailChimp and the statistical analyzes expire. A separate revocation of the dispatch or the statistical evaluation is unfortunately not possible. You will find a link to cancel the newsletter at the end of each newsletter.

We also inform you that the legal basis for the consent to the sending of e-mail addresses is based on Article 6 Paragraph 1 Letter a, 7 GDPR and Article 7 Paragraph 2 No. 3 and Paragraph 3 UWG .

The use of the mail service provider MailChimp, the implementation of statistical surveys and analyzes and the logging of the registration process are based on our legitimate interests in accordance with Article 6 (1) (f) GDPR. Our interest is focused on the use of a user-friendly and secure newsletter system that serves both our business interests and meets user expectations.

We would also like to point out that you can object to the future processing of your personal data at any time in accordance with the legal requirements of Article 21 GDPR. The objection can be made in particular against processing for direct advertising purposes.

8. Contact options via the website

Due to legal regulations, the MEDIOLA website contains information that enables quick electronic contact to our company and direct communication with us, which also includes a general address for so-called electronic mail (e-mail address).

Accordingly, on our website we offer you the opportunity to contact us by e-mail and/or via a contact form. In this case, the information provided to you, including the contact details provided, will be stored for the purpose of processing your contact. We do not pass on this data without your consent. A comparison of the data collected in this way with data that may be collected by other components of our site does not take place either.

The data you enter in the contact form will remain with us until you ask us to delete it, revoke your consent to storage or the purpose for data storage no longer applies (e.g. after your request has been processed). Mandatory legal provisions – in particular retention periods – remain unaffected.
